Terms of Service
These Terms govern your access to the Impulsum website, accounts, community tools, launcher delivery, servers, and related services (collectively, the “Service”). Please read them before creating an account or downloading software.
1. Agreement to these Terms
By creating an account, accessing authenticated features, downloading a launcher, or otherwise using the Service, you agree to these Terms, the Privacy Policy, and the Community Rules. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you are authorized to bind it.
2. Eligibility and accounts
You must be at least 13 and meet any higher minimum digital-consent age where you live, or have legally valid parent or guardian authorization. You must provide accurate information, maintain control of your login methods, and promptly report suspected account compromise through the Impulsum Discord. You are responsible for activity performed through your account to the extent permitted by applicable law. Accounts may not be sold, transferred, shared, automated, or used to evade enforcement.
3. Limited permission to use the Service
Subject to these Terms, Impulsum grants you a personal, limited, revocable, non-exclusive, non-transferable permission to access the Service for lawful, non-commercial fan-preservation and community purposes. No ownership rights are transferred. You must use only game copies and other content you are legally entitled to possess and use.
4. Prohibited conduct
You may not:
- distribute, request, upload, link to, or facilitate access to copyrighted game files or other material without authorization;
- use cheats, malicious software, credential theft, automation, scraping, denial-of-service activity, vulnerability exploitation, or access-control bypass;
- reverse engineer, tamper with, modify, redistribute, or impersonate an Impulsum launcher or service except where applicable law expressly permits it;
- harass, threaten, stalk, exploit, defraud, impersonate, dox, spam, or evade another user’s block;
- probe or test security without prior written authorization, conceal malicious activity, or interfere with logging, moderation, authentication, or service operation;
- use the Service in violation of law, third-party rights, platform rules, sanctions, export controls, or the Community Rules.
5. Launcher, software, and system risk
Launcher software is supplied only to facilitate access to the preservation Service; it does not include or grant rights to commercial game content. You are responsible for confirming compatibility, maintaining backups, using current security software, and deciding whether to run any executable. Software, patches, servers, protocols, and dependencies may change, stop working, conflict with other software, trigger third-party security tools, or result in loss of settings, progress, connectivity, or data. Do not use the Service on a system where interruption or data loss could cause material harm.
6. Community content and moderation
You retain rights you hold in content you submit. You grant Impulsum a worldwide, non-exclusive, royalty-free license to host, reproduce, process, display, and transmit that content only as reasonably necessary to operate, secure, moderate, and improve the Service. You represent that you have the rights needed to submit it. Impulsum may investigate reports; preserve relevant records; remove content; restrict features; reset identifiers; or warn, suspend, or terminate accounts. Moderation decisions may rely on available evidence and are not guaranteed to prevent every harmful interaction.
7. Third-party services and intellectual property
The Service relies on third parties including Discord, Supabase, Netlify, Cloudflare, Resend, and potentially payment providers. Their services and terms are separate, and Impulsum does not control their availability, security, conduct, or policy changes. Impulsum is a fan preservation project and is not affiliated with, endorsed by, sponsored by, or connected to Electronic Arts, EA Sports, FIFA, football governing bodies, console manufacturers, or game publishers. Their names, games, artwork, and marks belong to their respective owners. Nothing in these Terms grants rights in third-party property.
8. Service changes, access, and termination
The Service may be modified, limited, interrupted, migrated, or discontinued at any time. Server state, accounts, friendships, launcher access, virtual items, statistics, squads, currencies, and progress may be reset or lost and have no guaranteed monetary value. Impulsum may restrict or terminate access for suspected violations, legal demands, security risk, operational necessity, inactivity, or discontinuation. You may stop using the Service at any time and may request account deletion through the authenticated Privacy Center.
9. No warranties
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” with all faults and without warranties of any kind. Impulsum and Monolith Systems disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, compatibility, availability, quiet enjoyment, and any warranty arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, error-free, safe, free of harmful components, compatible with your device or software, or that data will be preserved or recoverable.
10. Assumption of risk
You voluntarily assume the risks ordinarily associated with downloading and running community software, connecting to unofficial preservation servers, interacting with other users, relying on third-party platforms, and using an experimental or discontinued-game environment. This includes service interruption, account action by third parties, incompatibility, security warnings, corrupted data, loss of progress, and exposure to user conduct. This provision does not waive rights that applicable law does not allow you to waive.
11. Limitation of liability
To the fullest extent permitted by law, Impulsum, Monolith Systems, and their owners, contributors, moderators, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, goodwill, opportunity, use, content, progress, or data; device or software damage; substitute services; or claims arising from third-party conduct, even if advised that such harm was possible.
To the fullest extent permitted by law, the aggregate liability of those parties for all claims arising from or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid directly to Impulsum for the Service during the 12 months before the event giving rise to the claim or (b) USD $100. The exclusions and cap apply regardless of the legal theory and even if a remedy fails of its essential purpose.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any consumer right or other liability that applicable law does not permit to be excluded or limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
12. Indemnity
To the extent permitted by applicable law, you will defend, indemnify, and hold harmless Impulsum, Monolith Systems, and their owners, contributors, moderators, volunteers, contractors, and service providers from third-party claims, losses, liabilities, damages, judgments, penalties, and reasonable legal costs arising from your unlawful conduct, your content, your infringement of another person’s rights, or your material violation of these Terms. This obligation does not require indemnification for a protected party’s own unlawful conduct and may not apply to consumers where prohibited.
13. Consumer and regional rights
These Terms do not reduce mandatory protections available under the law where you live. EU, EEA, UK, and other consumers retain non-waivable statutory remedies and protections against unfair contract terms. If a provision conflicts with mandatory local law, it applies only to the maximum lawful extent. Free digital services may still carry statutory obligations where personal data or another counter-performance is provided.
14. Disputes and informal resolution
Before filing a claim, you and Impulsum should attempt in good faith to resolve it through the Impulsum Discord support channel, unless urgent relief, a legal deadline, or applicable law makes that impractical. These Terms do not impose arbitration, waive class rights, select a court, or select governing law; those provisions require jurisdiction-specific legal review before adoption.
15. General terms
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; Impulsum may assign them as part of a restructuring, transfer, or operation of the Service, subject to applicable law. Headings are for convenience. These Terms, the Privacy Policy, and Community Rules form the agreement concerning the Service.
16. Changes and contact
Material changes will be posted with a revised effective date and, where required, additional notice or consent. Questions, security reports, conduct reports, and support requests should be submitted through the official Impulsum Discord. Never post passwords, authentication tokens, secret keys, government identifiers, or other sensitive information in a public channel.
